Competition General Terms and Conditions

The Promoter

  1. The promoter is the Crown in Right of Tasmania represented by the Department of Justice (WorkSafe Tasmania) (“WorkSafe Tasmania”). General

  1. These general terms and conditions together with any specific terms, conditions and rules set out below for each competition comprise the terms and conditions for each Competition (“Terms and Conditions”).
  2. By entering a WorkSafe Month 2019 competition (“Competition”) entrants agree to be bound by these Terms and Conditions.
  3. In the event of any dispute regarding these Terms and Conditions, the conduct of any party (including any entrant to a Competition), the results of any Competition and all other matters relating to any Competition; the decision of the Promoter will be final and no correspondence or discussion will be entered into.
  4. By entering a Competition, entrants warrant that all information submitted by them to the Promoter is true, accurate, current and complete.
  5. Employees of the Promoter are ineligible to enter any WorkSafe Month 2019 Competition.

Entries

  1. All Competition entries (“Entry” or “Entries”) become the property of the Promoter.
  2. Entries that do not comply with these Terms and Conditions will not be accepted and will be deemed ineligible.
  3. Entries must be made in the manner and by the closing date specified in these Terms and Conditions.
  4. Entries must comply with all applicable laws and must not contain any material that is deemed by the Promoter to be offensive or defamatory.
  5. Incomplete, ineligible or incomprehensible Entries will not be accepted and will be deemed ineligible.
  6. The Promoter accepts no responsibility for lost, incomplete, incorrectly submitted, delayed, corrupted or misdirected Entries.
  7. The Promoter reserves the right to, at any time, verify the validity of any Entry and the eligibility of any entrant and to disqualify any entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the Entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Cancellation or suspension of Competitions

  1. The Promoter reserves the right to cancel or amend a Competition (including the terms and conditions of any Competition) at any time without prior notice.
  2. Without limiting the operation of any other provision in these Terms and Conditions, if any Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud.
  3. The Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    • to disqualify any entrant; or
    • to modify, suspend, terminate or cancel each, all or any combination of the Competitions, as appropriate.

Winners

  1. Competition winner(s) will be published on the WorkSafe Tasmania Month website.
  2. As a condition of accepting the prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize sponsor in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
  3. By entering a competition, entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting each, all or any combination of the Competitions (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Prizes

  1. Each Competition prize must be taken as offered and is not exchangeable, transferable, redeemable for cash or for resale. Each prize is subject to availability and if any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  2. If for any reason a winner does not redeem a prize (or an element of the prize) by any time period stipulated by the Promoter or if the winner cannot be contacted by the Promoter using the contact details supplied by the winner in their entry form, then the prize (or that element of the prize) will be forfeited.
  3. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of accepting and/or using any prize except for any liability which cannot be excluded by law.
  4. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability or merchantability of any prize. To the fullest extent permitted by law, the Promoter is not liable for any loss suffered to any prize winner by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods to that prize winner.

Liability

  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 or similar consumer protection laws in the State and Territories of Australia applicable to each Competition (“Non-Excludable Guarantees“). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in connection with any Competition.
  2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) are not responsible for and exclude all liability (including liability for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
    • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    • any theft, unauthorised access or third party interference;
    • any Entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    • any variation in prize value to that stated in these Terms and Conditions;
    • any tax liability incurred by a winner or entrant; or
    • use/taking of any prize.

Personal Information

  1. The Promoter collects personal information, as that term is defined in the Personal Information Protection Act 2004 (Tas) in order to conduct each Competition and may, for this purpose, disclose such information to third parties. Entry is conditional on providing this information. Entrants should direct any requests to access update or correct information to The Promoter.

Competition Specific Conditions

Steps for Wellness Walk

  1. Register and attend the Steps for Wellness Walk (“Walk”) to win a Garmin Vivosmart 4 Activity Tracker.
  2. Registrations (entries) for the competition will be accepted from Saturday 10 August at 12.00am and close at 11.59pm on Tuesday 24 September.

Prizes

  1. One winner will receive a Garmin Vivosmart 4 Activity Tracker.

How to enter

  1. To be eligible, entrants must:
    • have registered online to attend the Walk at www.worksafetasmonth.com.au between Saturday 10 August at 12.00am and 11.59pm on Tuesday 24 September; and
    • attend and participate in the Walk on 25 September.
  2. Competition entry is free but entrants may only lodge one entry.

Selection and Notification of Winner and Special Terms and Conditions

  1. The Promoter accepts no responsibility for late, lost or misdirected registrations.
  2. One winner will be drawn at random and announced by a representative of the Promoter at the Walk on Wednesday 25 September 2019.
  3. This Competition is coordinated in conjunction with the ‘WorkSafe Month 2019 Competition Terms and Conditions’.

WorkSafer Expo Coffee Voucher and Promotional Pack Giveaway

  1. The WorkSafer Expo coffee voucher and promotional pack giveaway will commence Wednesday 30 October 2019 at 10.00am.
  2. The competition will conclude when 200 coffee voucher and promotional packs have been given away.

Prizes

  1. The first 200 individuals to attend the Expo and present to the information desk will receive a coffee voucher and promotional pack.

How to enter

  1. To be eligible, entrants must:
  2. be one of the first 200 people to attend the Expo; and
  3. visit the WorkSafer Expo information desk located at the entrance to the Expo to receive their coffee voucher and promotional pack.

Selection and Notification of Winner and Special Terms and Conditions

  1. Entry to the WorkSafer Expo is free, but each individual may receive only one coffee voucher and promotional pack.
  2. Only 200 coffee voucher and promotional pack giveaways are available.
  3. This Competition is coordinated in conjunction with the ‘WorkSafe Month 2019 Competition Terms and Conditions’.

WorkSafer Expo Register Online and Attend to Win

  1. The WorkSafer Expo Register online and attend to win competition will commence Saturday 10 August at 12.00am and close at 11.59pm on Tuesday 29 October.

Prizes

  1. One winner will receive an Apple Watch (Series 3).

How to enter

  1. To be eligible, entrants must:
    • Have registered online to attend the WorkSafer Expo at worksaferexpo.com.au/registration between Saturday 10 August at 12.00am and 11.59pm on Tuesday 29 October;
    • attend the WorkSafer Expo and present to the information desk to confirm their registration and attendance

Selection and Notification of Winner and Special Terms and Conditions

  1. The Promoter accepts no responsibility for late, lost or misdirected registrations.
  2. Competition entry is free but entrants may only lodge one entry.
  3. One winner will be drawn at random and announced at the conclusion of the WorkSafer Expo on Wednesday 30 October 2019 by a representative of the Promoter.
  4. This Competition is coordinated in conjunction with the ‘WorkSafe Month 2019 Competition Terms and Conditions’.

WorkSafer Expo Attend to Win

  1. The WorkSafer Expo attend to win competition will commence on 30 October 2019 at 10.00am and will finish at 4.00pm.

Prizes

  1. One winner will receive an Apple Watch (Series 3).

How to enter

  1. To be eligible, entrants must:
    • attend the WorkSafer Expo; and
    • present to the information desk to complete an entry form.
